In 2005, the Italian Marco Pieraccioli thought that he should not pay for the system he did not want to use, so he filed a lawsuit in court and asked Microsoft to return the money to him. A few days ago, the Italian Supreme Court ruled that if the user does not agree to use the pre-installed operating system, he has the right to ask the manufacturer to refund the relevant license fee.

In addition, this case also involves competition issues between businesses. Microsoft's direct request for OEMs to pre-install their systems has violated the freedom of competition of other merchants. Pieraccioli told the media that the court believes that PC pre-installed software is different from car pre-assembled parts (such as four tires, engines, etc.), the latter must be bundled, while the former can be sold separately. The court said that Microsoft should provide two contracts for consumers, one for the purchase of the device, and the other for the first time when he opens the computer, asking if he accepts the system. If the user chooses not to accept it, Then he has the right not to pay "Microsoft Tax".

Although the court's ruling does not only point to Windows, it seems that only one company like Microsoft is currently eligible. It is unclear whether the ruling also applies to Apple. After all, the company does not sell software separately as Microsoft does.
