Previously, a number of consumers filed a collective lawsuit against Apple in the Federal District Court of Oakland, California, in the United States, saying that the wording in Apple's iPhone 4S mobile phone commercial advertisement and Apple's statement were false and misleading. These collective plaintiffs believe that the performance of the Siri service in the iPhone 4S mobile phone is excellent in TV commercials, but it is eclipsed in real life.
A collective plaintiff stated that he could not reproduce a similar situation with the Siri service used in iPhone 4S TV commercials. Another plaintiff also said that after issuing instructions to the iPhone 4S phone, Siri could not understand. After a long time "thinking", the phone gave the wrong answer.
In response to this class action lawsuit, Apple recently hired Gibson Dunn & Crutcher to launch a counterattack. The law firm recently stated in a legal motion submitted to the court that the Siri service is still in beta, and although the technology is not yet complete, it is still the industry's leading edge technology.
Apple believes that the collective plaintiff did not clearly explain how the iPhone 4S TV ads misled consumers, nor did they point out the specific link between their experience and these ads. Apple also said that if consumers are dissatisfied with the performance of Siri technology, they should have returned these phones in accordance with Apple's 30-day return policy, but the collective plaintiff did not.
Apple's legal motion writes: "They (Note: refers to the collective plaintiff) only for the general description of Apple's advertising content, only a non-exhaustive analysis of the material of the Apple website, they are for Siri technology The dissatisfaction is entirely from a highly personal experience. Most notably, if these plaintiffs are not satisfied with Siri's performance by purchasing an iPhone, they could have used Apple's 30-day return policy or one-year warranty to protect their rights. But they did not do this, but instead adopted the method of suing Apple. The content of the lawsuit filed by the collective plaintiff has not yet reached the level acceptable to the court. ”
For the motion Apple submitted to the court, one of the lawyers of the collective plaintiff has not commented.
