The Microsoft Service Agreement clearly states that Microsoft will check your system to see if users are playing pirated games or using unauthorized hardware peripherals. It’s a bit strange that Microsoft’s narrowing down on pirated software to games only in its agreement statement.

Maybe this part of the agreement is related to their xbox game console. Some gamers often crack the host to load pirated games. This situation is more common in the original Xbox. Now, Microsoft has the right to search for such cracks and disable these consoles to access Microsoft services. Because the language of these terms of service is so vague, it is unclear whether Microsoft plans to publish the pirated game information they collect, or they simply use the pirated content.

Another question is how Windows 10 will work across PCs, mobile phones, Xbox, HoloLens and surface Hub. End-user license agreements now require a lot of content to be written, including protection for stolen phones, Xbox modules, enterprise security, and the required updates. Unifying Windows 10 is a technical challenge, but now it seems to be a serious legal challenge that requires the consolidation of different license terms into a single agreement covering all different usage scenarios.
